Five IHC Judges Challenge Transfer Ruling in SC

Islamabad( The COW News Digital) Five judges of the Islamabad High Court (IHC) have filed an intra-court appeal in the Supreme Court of Pakistan, challenging the verdict in the controversial judges’ transfer and seniority case.

The appeal was submitted through senior advocate Munir A. Malik, a renowned constitutional lawyer. The judges contest a Supreme Court ruling that upheld the transfer of judges to the Islamabad High Court and referred the seniority matter to the President of Pakistan.

Earlier, a five-member bench of the Supreme Court had declared that the transfer of judges to the IHC was lawful and within jurisdiction. The bench, however, had left the decision on the seniority of the transferred judges to the discretion of the President, a move that sparked serious concerns within the judicial community.

In the newly filed appeal, the petitioners have requested the apex court to set aside its earlier decision delivered on June 19, 2025, and declare it null and void. The judges further urged the court to suspend the June 19 judgment until the intra-court appeal is adjudicated.

Along with the appeal, the judges have submitted an application for a stay order, seeking to halt any action regarding the determination of seniority of the transferred judges until the matter is resolved. The plea also requests the court to restrain the President from making any decisions related to seniority during the pendency of the appeal.

The petition additionally appeals to the Supreme Court to bar the Judicial Commission from appointing Justice Sarfraz Dogar as the permanent Chief Justice of the Islamabad High Court until a final decision is reached in the intra-court appeal.

Legal experts say the case raises important questions about judicial independence, constitutional process, and the authority of various institutions in determining the structure and leadership of the judiciary.

The intra-court appeal by IHC judges is expected to gain considerable attention as it may redefine how judicial transfers and seniority disputes are handled in Pakistan’s judicial system.

As of now, no date has been fixed for the hearing of the intra-court appeal.
